What is the Construction Contracts Act 2013?

The new construction act, passed in 2013, allows parties involved in a construction dispute to resolve their disagreement through adjudication. This limits the costs and delays associated with litigation and arbitration, making it an incredibly useful method of dispute resolution.

The New Construction Act

If you are party to a construction contract and you have a payment dispute, the construction contracts act 2013 enables you to settle the grievance through adjudication. The Construction Contracts Act 2013

Adjudication is available to anyone with a contract relating to construction, including mechanical contracts, building contracts and sub-contracts. The original contract can be written or oral, although it must:

  • Have a value of €10,000 or more
  • Relate to a building of 200 square metres or more, if it is a dwelling house

As long as your contract meets these provisions, you can demand that an independent adjudicator be appointed to resolve your payment dispute. Any party to the contract can demand adjudication at any time.

Under the construction contracts bill Ireland, an adjudicator must be appointed within five days of the demand being made. A final decision – called an Adjudication Award – must be made within 28 days of the papers being referred. If it is found that payment is outstanding, the remaining sum must be discharged in monthly instalments.
