Latent defects

A latent defect is a construction defect that is concealed and not readily apparent to the home-owner.

Normally those affected by latent defects will find that the work carried out by constructors appeared to be of a reasonable standard. It is only later that the hidden flaws become apparent – either because the home-owner has inspected the defective property more closely, or because an event occurs that exposes the full extent of the construction defect (such as heavy rain.)

For example, if there is a breach of contract or a case of negligence, a home-owner will be entitled to pursue legal action against the contractor for defective property.
