Charity law Ireland

In Ireland, charitable organisations must comply with the Charities Act 2009. The Charities Regulatory Authority (CRA) was set up in October 2014 to ensure charities meet their legal obligations.

All charities must register with CRA, and must thereafter adhere to the rules set out by the national statutory agency. These are extensive and cover topics such as:

  • Complying with the definition of a ‘charity’
  • Obtaining a unique charity registration number and stating it on all published literature
  • Reporting accounts and audits
  • Fundraising and lobbying requirements
  • Conditions relating to trustees

Charity Appeals Tribunal

If the CRA finds that an organisation is not meeting the regulations, it may refuse to register it, or it may remove the organisation from the register.

Should an organisation wish to appeal a decision made by the CRA, it has the right to take the matter to the Charity Appeals Tribunal. The appeal must be brought within 21 days of the CRA’s decision.
